Do the same rules about early release and getting tagged apply on a 2nd prison sentence?

I am back in court for drink driving and because of my record could be looking at prison. The last time I was there I only had to do half the sentence and got released a bit before that on tag. If I get sent doen again does the same apply or is it different?

Your second prison sentence for the same crime denotes a repeat offender (You didnt learn the first time?). Therefore the before mentioned programs do not (THANK GOODNESS) apply. You will be seen as a career criminal.

Reply:I would guess you'll still get the early release..but don't you think it would be a good idea to use the time to reflect life in prison...You couldn't have found it that bad the 1st time....or else you'd have made sure you never went back
Reply:LEGALLY SPEAKING (unlike prior emo poster), yes, you're still eligible for early release, since early release only means that you're being released for GOOD BEHAVIOR. Technically, you could have served your full first sentence if you were clogging the toilet, shanking your bunkmate and kicking the CO in the nuts everytime you saw him.





So, YES, even if you're being sentenced to STATE TIME, you are eligible for time reduction based on good behavior. What happens to your sphincter while in prison is another story.

Reply:Your current offence was committed while you were still on licence, the supervising officer and the priso will be well aware of this and it will colour your chance of early release.
